The No.3 Shanghai Intermediate Court recently adjudicated a case of infringement of registered trademark exclusive rights and unfair competition dispute. XIAOMI-W (01810.HK) filed a lawsuit against Xiaomi Lingdu (literal translation of "小米零度")for selling smart toilet products with a trademark that resembles XIAOMI-W's “M” character and using “Xiaoai Xiaoai” as its voice call command. After hearing the case, the court identified that the conduct of Xiaomi Lingdu constituted trademark infringement and unfair competition, and ruled that it should immediately stop the production, sale, promotion and use of products bearing the relevant infringing logos and speech command, take measures to eliminate the adverse impacts and be required to compensate XIAOMI-W RMB30 million.
