當中提及，對創新藥和原研藥品的試驗數據給予6年的保護期；對改良型新藥的試驗數據給予4年的保護期；對首仿藥品的試驗數據給予3年的保護期。在數據保護期內，其他申請人未經持有人同意，依賴受保護的數據申請藥品上市許可的，國家藥監局不受理不許可。

國家藥監局表示，條例修訂後從以藥品生產經營企業的管理為中心轉變為以藥品上市許可持有人為中心，強化藥品全生命周期全過程嚴格監管。(jl/u)
