XIAOMI-W (01810.HK)  +1.300 (+2.672%)    Short selling $338.94M; Ratio 7.072%   's legal department issued a statement regarding its lawsuit against Juhaokan Company (literal translation of “聚好看公司”) for commercial defamation. The company recently received a final court ruling dismissing Juhaokan’s appeal and upholding the original verdict.

The second-instance court found that, based on semantic, contextual, and specific entity correspondence analysis, combined with public perception, the first-instance court correctly concluded that the Weibo content posted by Juhaokan targeted Xiaomi.

The court noted that Juhaokan, viewing Xiaomi as a competitor, used slogans similar to Xiaomi’s, such as “the first great TV for young people (literal translation of "年輕人第一台好電視")” and “we embarks on a journey of the true starry sea (literal translation of "我們的征途是真正的星途大海")”, as promotional phrases.

The timing of the post during the Double 11 shopping festival further evidenced Juhaokan's intent to boost its own sales by defaming a competitor.

The first-instance court ruling on August 31, 2023, determined that Juhaokan, through its “Vidda Official Weibo” account, posted false and misleading information that insulted and disparaged Xiaomi, damaging its commercial reputation and product goodwill, constituting commercial defamation.

The court ordered Juhaokan to publish a statement on its “Vidda Official Weibo” account in a pinned position for seven consecutive days to mitigate the impact and to compensate Xiaomi for economic losses and reasonable expenses totaling RMB550,000.
